The administration of Donald Trump has proposed stricter regulations for hiring foreign workers in the United States and is currently seeking public feedback on the changes. The US Department of Labor (DOL) introduced new proposals on March 27 aimed at curbing misuse of H-1B visas and protecting wages of American workers. The proposed changes are expected to focus on wage structures and eligibility criteria, while petitions filed before June 30 are likely to remain unaffected. A 60-day window has been provided for stakeholders to submit their opinions.
Under the proposed rules, the administration intends to prevent the use of H-1B visas as a pathway to permanent residency, emphasizing that the visa is meant only for temporary employment needs. Priority in visa allocation will be given to candidates with a master’s degree or higher from US universities. Additionally, companies will need to prove that no suitable American candidate is available before hiring foreign workers. To discourage underpayment, the minimum wage requirement for H-1B workers is proposed to be increased by 30 percent, ensuring fair compensation and safeguarding domestic employment opportunities.
