Adluri Laxman approached the High Court after the passport authority refused to issue him a passport due to pending criminal cases. The court, however, declined to grant direct relief and instructed that a No Objection Certificate (NOC) must first be obtained from the trial court. It directed the passport authority to issue the passport only after such clearance is submitted.
The High Court further clarified that the NOC would be valid only for the purpose of issuing the passport. If the minister wishes to travel abroad, he must seek separate permission again from the trial court. This order highlights the legal requirement of court approval in cases involving pending criminal proceedings.
