

The Supreme Court made significant remarks on the continuation of reservation benefits within families that have already achieved social and economic advancement. The bench questioned whether children of parents who are both senior government officials still require reservation benefits. These observations were made during the hearing before Justices B.V. Nagarathna and Ujjal Bhuyan.
The court stated that once a family attains social mobility through education and economic empowerment, continuing reservation benefits for future generations may not be justified. Justice Nagarathna observed that such a practice could prevent the country from ever moving beyond the reservation system. The bench emphasized the need for a balanced approach to ensure benefits reach genuinely disadvantaged sections.
The Supreme Court also expressed concern that if a few families continue to dominate reservation benefits, the most backward and economically weaker people within the same communities may lose opportunities. The court focused on the scientific implementation of creamy layer rules currently applicable to OBCs. Notices were issued to the Central Government and related parties, while the hearing was postponed for further proceedings.
