

If West Bengal Chief Minister Mamata Banerjee refuses to resign, constitutional experts state that she can continue in office only until a new government is formed and a new Chief Minister is sworn in. However, as per constitutional provisions, a government cannot continue beyond its five-year term. This means a new government must be formed by the due date, and the existing administration cannot legally extend its tenure.
In such a scenario, the Governor may step in and take action. If the Chief Minister does not resign or fails to prove majority in the Assembly, the Governor can dissolve the government. Alternatively, a floor test may be ordered to establish majority. If no party secures a clear mandate, the Governor can recommend President’s Rule. The Governor’s role remains crucial, ensuring constitutional procedures are followed impartially.
