

The Supreme Court has delivered a significant ruling regarding the collegium system used for the appointment of judges in the higher judiciary. The court observed that the collegium's selection process is beyond the scope of judicial review and cannot be subjected to routine legal scrutiny. The judgment reinforces the autonomy of the judicial appointment mechanism and underlines the importance of maintaining institutional independence in the selection of judges.
The apex court also clarified that the process of judicial appointments does not fall under the ambit of the Right to Information (RTI) Act. While dismissing a petition filed by a senior judicial officer from Himachal Pradesh, the court stated that interference in collegium decisions could create unnecessary complications and affect the functioning of the judicial system. The ruling is being viewed as a major reaffirmation of the existing appointment framework.
