The Supreme Court has clarified key provisions relating to arrest and detention under Article 22(2) of the Constitution. It stated that the 24-hour period for producing an arrested person before a magistrate begins from the time of actual detention, and not from the time the police formally record the arrest.
An arrested person must be produced before the nearest magistrate within 24 hours, excluding the time required for the journey. The court observed that detention beyond this period without producing the person before a magistrate would violate the constitutional safeguard and may warrant immediate release. The bench also emphasised that detention must remain within reasonable limits in accordance with Section 58 of the Bharatiya Nagarik Suraksha Sanhita (BNSS).
