The High Court has clarified that subleasing a property without the owner's consent and written permission is illegal and invalid. It observed that a house in Cherlapally was unlawfully subleased and used as a police station without verifying ownership rights. The court termed the act as unauthorized occupation and directed the Director General of Police to conduct a proper inquiry and take necessary action based on the owner's complaint.
The petition was filed by Tirumala Lakshmanacharyulu, and the case was heard by Justice E.V. Venugopal. The petitioner stated that the property was originally leased to a society, which later subleased it to establish a police station without the owner’s approval. He also highlighted pending rent and electricity dues. The court noted that the lease period had expired and reaffirmed the petitioner’s ownership rights, directing authorities to resolve the matter within three months before closing the case.
