Ashutosh Ranka, co-convenor of the Cockroach Janta Party (CJP), has criticised the Central Government over the use of Section 163 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) amid protests at Jamia Millia Islamia in New Delhi. In a post on X, Ranka suggested that the government appeared to be relying on the same legal provision to address different situations. “First New Delhi and now Jamia, Central govt has found the ultimate solution to every problem: BNS 163,” he wrote, adding, “Shameful times ongoing.” His remarks came as restrictions were imposed outside the university amid continuing student protests.
Section 163 of the BNSS empowers designated magistrates to issue urgent orders to prevent potential danger, obstruction or disturbances to public tranquillity. The provision broadly carries forward the role of Section 144 of the earlier Code of Criminal Procedure (CrPC). It can be used to restrict gatherings and certain activities under specified circumstances. Its use during protests has prompted debate over balancing public order with the rights to peaceful assembly and freedom of expression. Ranka’s comments have added to the discussion surrounding the authorities’ response to demonstrations and the imposition of restrictions on public gatherings.
