The Supreme Court has clarified that the 24-hour period for producing an accused person before a magistrate begins from the moment the individual is taken into custody, rather than from the time of formal arrest. The Court observed that both detention and arrest restrict an individual's personal liberty in the same manner. Therefore, the time spent in police custody must also be considered while calculating the mandatory 24-hour period.
The Court further stated that the 24-hour countdown begins as soon as the police take a person into custody. It also criticised the approach adopted by certain High Courts for treating detention and formal arrest as having different legal statuses. The clarification reinforces the importance of protecting individual liberty and ensuring that legal safeguards are not bypassed through procedural distinctions between detention and formal arrest.
