FSSAI Action Against Nestlé India: Legal Cases Over Infant Food Claims

The Food Safety and Standards Authority of India (FSSAI) has initiated legal proceedings against Nestlé India Ltd over alleged non-compliance involving three infant nutrition products. The regulator examined NAN Excella Pro Stage 1, Lactogen Pro 1 and a follow-up formula, along with promotional material available on e-commerce platforms. FSSAI flagged claims related to “5 HMOs” and whey protein in NAN Excella Pro Stage 1, while Lactogen Pro 1 carried a claim describing its whey protein as easy to digest. The regulator said such promotional material does not comply with regulations governing the marketing of infant foods.

Separately, laboratory testing found a sample of Nestlé India’s follow-up formula to be below the prescribed standard for biotin. A referral laboratory also confirmed that the sample did not meet the required biotin level. Following these findings and the company’s explanations, FSSAI filed three separate adjudication cases. Nestlé India shares fell nearly 2% to around ₹1,345.45 on the BSE during Friday’s trading session.
