

Khairatabad MLA Danam Nagender told the Telangana High Court on Tuesday that he had neither resigned from the Bharat Rashtra Samithi (BRS) nor taken membership in the Congress party. A bench comprising Chief Justice Justice Aparesh Kumar Singh and Justice G.M. Mohiuddin heard petitions challenging the Speaker’s decision concerning the disqualification of MLAs. Senior advocate Gaurav Agarwal, appearing for Nagender, argued that disqualification cannot be based merely on photographs and media reports suggesting that an MLA had switched parties.
The counsel said media reports about Nagender meeting the Chief Minister and an AICC general secretary on March 15, 2024, and wearing a Congress scarf did not amount to a voluntary declaration that he had joined the Congress. He argued that media reports alone were insufficient to establish that Nagender had voluntarily given up his BRS membership. He also pointed out that BRS had not submitted any letter to the Speaker seeking action against Nagender and that the Assembly bulletin continues to list him as a BRS member. After hearing the arguments, the bench adjourned the matter to August 20.
