The Bombay High Court has directed the Brihanmumbai Municipal Corporation (BMC) to re-upload actor Dia Mirza’s video promoting an eco-friendly Diwali. The civic body had removed the video from its social media platforms on Monday following objections from some political leaders. Hearing a suo motu petition related to air and noise pollution, a bench comprising Justices Girish Kulkarni and Neela Gokhale expressed deep displeasure over the controversy. The court observed that it was unfortunate to give a different interpretation to a campaign intended to create awareness about environmental protection and the harmful effects of firecrackers. It also said the BMC commissioner’s decision to involve celebrities in the awareness campaign was appropriate.
The bench stressed that environmental protection has nothing to do with religion, caste or community, as everyone breathes the same air. It also reminded citizens that India is a secular country and that the Constitution expects everyone to respect people irrespective of their religion, caste or background. The court said Mumbai’s identity rests on unity and a strong sense of belonging, which should not be disturbed by irresponsible comments. It further clarified that its directions on firecrackers and pollution were not limited to Diwali but concerned the control of air and noise pollution throughout the year. The court therefore asked the BMC to restore Dia Mirza’s video.
