The Trump administration has suffered a significant legal setback after a federal judge in New York struck down its policy suspending immigrant visa processing for citizens of 75 countries. The policy, introduced by the State Department in January, had indefinitely halted the processing of immigrant visas for nationals from the affected countries.
US District Judge Jeannette Vargas ruled that the policy was contrary to federal immigration law and exceeded Secretary of State Marco Rubio’s statutory authority. The court also found that suspending visa processing solely on the basis of nationality conflicted with the legal framework governing consular decisions. The ruling is expected to provide relief to applicants whose visa cases were affected by the freeze, although the exact timeline for resuming processing remains subject to implementation by the US government.
