The Supreme Court of India has asked the Ministry of Electronics and Information Technology (MeitY) to incorporate measures into its proposed policy to prevent the unauthorized uploading, sharing and commercial exploitation of court hearing recordings. The move aims to address the misuse of judicial proceedings captured on video and ensure that such recordings are not circulated or used for commercial purposes without proper authorization.
A three-judge Bench headed by Chief Justice of India Surya Kant, along with Justices Joymalya Bagchi and V. Mohana, stressed the need to implement the court's earlier directions. The Bench reiterated that prior approval from the competent authority is mandatory before extracting, sharing or using clips of judicial proceedings. The proposed MeitY policy is expected to establish mechanisms to identify violations and take appropriate action against those misusing court hearing recordings.
