Peaceful Protest Is a Constitutional Right - CJI Surya Kant

Chief Justice of India Surya Kant, while hearing petitions alleging police excesses against student protesters, said that the right to conduct peaceful and lawful protests is protected under the Constitution. He observed that peaceful demonstrations alone cannot be a reason for authorities to use force against protesters.

The CJI further stated that allegations of excessive police action must be independently investigated. He emphasized the need for a uniform protocol across the country to handle public protests and noted that the mere presence of a protest does not justify actions like lathi-charge. He added that discipline is an essential part of the democratic process.
