The administration of former U.S. President Donald Trump has faced another legal setback. A U.S. trade court has ordered the government to refund tariffs that were collected illegally from importers. After the Supreme Court ruled last month that these tariffs were unlawful, the court on Wednesday directed the government to start the refund process immediately. The total amount to be returned is about $1.3 trillion (around ₹11,90,531 crore).
Judge Richard Eaton of the United States Court of International Trade in Manhattan issued the order. He directed the government to finalize entry values for shipments without reassessing the costs of millions of shipments brought into the U.S. The court also instructed that the tariffs collected should be returned to importers along with interest.
Usually, importers pay an estimated amount when goods enter the United States. The final amount is confirmed after about 314 days, a process known as “liquidation”. The judge said customs authorities already have the system to process refunds if importers have paid more than the estimated tariffs. Therefore, refunds should be issued quickly without further delay.
