The Allahabad High Court has made significant observations stating that individuals who feel they cannot financially support their spouse and children after divorce should refrain from getting married. The court emphasized that citing poor financial conditions is not a valid excuse to evade the responsibility of paying maintenance to the wife.
The bench clearly stated that after marriage, the husband is legally bound to take responsibility and provide maintenance. These remarks were made during the hearing of a petition challenging a Family Court’s order. The court reiterated that financial accountability towards one’s family is a fundamental legal obligation that cannot be ignored.
