

The Supreme Court has issued notices to Chief Election Commissioner Gyanesh Kumar and the other two Election Commissioners while hearing petitions challenging alleged unilateral decisions by the Election Commission. However, the court declined to pass an interim order seeking Kumar’s immediate suspension or removal from office. The bench observed that suspending the CEC at this stage would be an extraordinary step. The matter was heard by a bench comprising Chief Justice of India Surya Kant and Justices Joymalya Bagchi and V. Mohana.
The petitions allege that 14 key decisions related to the electoral-roll revision process were taken without the concurrence of the other Election Commissioners. The Supreme Court has sought responses from the Election Commission and the Centre and said it could reconsider or annul decisions if the records establish that they were contrary to law. The bench also made it clear that it could not pass an interim order solely on the basis of media reports. The court will examine the decision-making process and compliance with the statutory framework in the next stages of the case.
