The Supreme Court of India has clarified that members of Hindu communities classified as Other Backward Classes (OBCs) cannot automatically claim OBC reservation benefits under a particular community classification after converting to Islam. The ruling came while the court upheld a Madras High Court decision concerning the eligibility of a converted individual for reservation under the OBC Muslim category. A bench comprising Justices Prashant Kumar Mishra and Sree Chandrashekhar dismissed the Tamil Nadu government’s petition challenging the High Court’s decision. The court emphasised that reservation eligibility must be determined under the applicable legal framework and cannot be established solely on the basis of a person’s previous religious or social identity.
The court also observed that a person who converts to another religion and later returns to the Hindu social system cannot establish eligibility for special provisions under Article 16(4) of the Constitution merely by relying on their earlier status. The relevant circumstances and applicable legal requirements must be examined. Meanwhile, the BJP welcomed the ruling, with party spokesperson Gaurav Bhatia claiming that it dealt a setback to what he described as the appeasement politics of the Congress, Samajwadi Party and Trinamool Congress. These political remarks represent the BJP’s position on the judgment.
