Congress leaders Sonia Gandhi and Rahul Gandhi received relief in the National Herald case as the Delhi Rouse Avenue Court refused to take cognizance of the charge sheet filed by the Enforcement Directorate (ED). The court observed that the investigation was not based on an FIR but on a private complaint filed by an individual.
The court clarified that at this stage, Sonia Gandhi, Rahul Gandhi, and other accused are not entitled to receive a copy of the FIR. However, it allowed the ED to continue further investigation. The court also noted that the case originated from a private complaint filed by BJP leader Subramanian Swamy and proceeded based on the magistrate’s summons, not an FIR.
