

The U.S. government is set to introduce higher filing fees for several applications under the EB-5 Immigrant Investor Program, which provides an immigration pathway for eligible foreign investors who make qualifying investments in the United States and meet the required job-creation conditions. The revised fees are scheduled to take effect from November 30. USCIS says its fee structure is intended to cover the costs associated with application processing, background checks, eligibility determinations and fraud detection. Under the reported revision, the fees for forms including I-526, I-526E, I-829 and I-956F are set to increase substantially. The EB-5 programme generally requires investors to create at least 10 full-time jobs in a qualifying commercial enterprise. USCIS currently lists the statutory EB-5 investment requirements separately from filing fees, and applicants should check the agency’s latest fee schedule before filing. The increase is particularly relevant to Indian investors, who have seen growing demand for EB-5 visas and have faced visa-availability and processing considerations.
