The Supreme Court has directed the Andhra Pradesh State Election Commission (APSEC) to decide by tomorrow on the YSR Congress Party’s (YSRCP) plea seeking an extension of the nomination deadline for urban local body elections in areas where candidates were allegedly prevented from filing their nominations due to violence. The court also directed the Commission not to publish the final list of candidates on the scheduled date and to defer its publication until October 25. The petition raises concerns over whether all eligible candidates were given a fair opportunity to participate in the electoral process.
Observing the importance of democratic participation, the Supreme Court emphasised that free and fair elections are part of the Constitution’s basic structure and that the right to file nominations is an essential aspect of this principle. The court noted that although judicial review in election matters requires due consideration of the electoral process, it cannot be completely excluded. It directed APSEC to examine representations submitted by affected candidates, including relevant electronic evidence, and decide whether the nomination deadline should be extended in the concerned areas. If an extension is granted, candidates must be provided at least 48 hours to file their nominations from the time the decision is published.
The Supreme Court also directed the Director General of Police (DGP) to ensure adequate police protection, CCTV coverage and compliance with the court’s directions. The authorities have been asked to submit compliance reports, and the matter is scheduled for further hearing on October 27. The Commission’s decision is expected to determine whether candidates who were allegedly prevented from filing nominations will receive an additional opportunity to contest. The court’s directions focus on ensuring that the election process remains fair and that eligible candidates are not denied the opportunity to participate because of alleged intimidation or violence.
