Major Changes in H-1B Visa Policy

The H-1B visa programme, which is crucial for foreign professionals working in the United States, could undergo significant changes over the coming year, according to U.S. Department of Labor Inspector General Anthony D’Esposito. In an interview, D’Esposito said the government was conducting a wide-ranging investigation into alleged abuses of the foreign-labor visa system. He said the probe goes beyond paperwork reviews and involves gathering evidence related to the alleged misuse of the system. He indicated that the foreign-labor visa programme could look very different 365 days from now.

D’Esposito did not announce plans to abolish the H-1B programme. His remarks, however, signal continued investigations and potentially stronger enforcement against companies and practices suspected of abusing the foreign-labor system. The Department of Labor’s Office of Inspector General has already conducted field checks and other investigative actions as part of its nationwide H-1B fraud probe. Further enforcement measures and policy changes could follow depending on the findings of the investigation.
