The Telangana High Court has issued key directions in a tender dispute concerning the construction of Radial Road-2, an 81.15-kilometre project undertaken by Hyderabad Growth Corridor Limited. The court directed that the L-1 bidder awarded the contract for the road connecting Kotwalguda and Nacharam be added as a respondent in the case. It observed that the arguments of the bidder who qualified in both the technical and financial evaluations must also be considered. The court further stated that it could not order a stay on the tender process before the government filed its counter. Justice B. Vijaysen Reddy heard a petition filed by Sushee Infra and Mining Limited, challenging its disqualification at the technical bid stage.
Senior counsel Avinash Desai, representing the petitioner, argued that the company had been disqualified without proper examination of its experience certificate. He contended that, under the tender rules, the authorities should seek clarification if they have doubts about submitted documents. He also submitted that the company had quoted ₹600 crore less than the successful bidder and argued that awarding the contract without considering its bid could result in a loss to public funds. Additional Advocate General Thera Rajanikanth Reddy, however, told the court that the bid had been rejected because the company did not meet the technical eligibility requirements. After hearing both sides, the judge said the validity of the technical qualification certificate would be considered after the government filed its counter. The next hearing has been scheduled for the 29th of this month.
