The High Court has clarified that under the Hindu Succession Amendment Act, 2005, a daughter has equal rights in her father’s property by birth, just like a son. The court stated that a daughter is entitled to an equal share in ancestral property irrespective of whether the father was alive when the amended law came into force.
The court further observed that for claiming equal property rights, it is sufficient if the daughter was alive on September 9, 2005, when the amendment came into effect. The ruling is being viewed as a significant step towards ensuring equality in inheritance rights for women.
