In a significant legal clarification, the Andhra Pradesh High Court has ruled that the six-month cooling-off period is not mandatory in cases of divorce by mutual consent. The court observed that when both husband and wife have mutually agreed to part ways, insisting on a compulsory waiting period may not always be necessary.
The judgment was delivered by Justice Nimmagadda Venkateswarlu, who emphasized that courts have the discretion to waive the cooling-off period based on the circumstances of each case. This ruling is expected to provide relief to couples seeking a quicker resolution to their marital disputes through mutual agreement.
