

The controversy surrounding the appointment of the Chief Election Commissioner and Election Commissioners has reached the Supreme Court once again. Petitions challenging the 2023 appointment law have questioned the exclusion of the Chief Justice of India from the selection committee. Under the new law, the selection panel comprises the Prime Minister, the Leader of Opposition in the Lok Sabha and a Union Cabinet minister nominated by the Prime Minister.
The petitioners have argued that the appointment mechanism could give the executive greater influence over the Election Commission. On September 23, a two-judge Supreme Court bench delivered a split verdict on whether the matter should be referred to a larger Constitution Bench. The court has now agreed to examine a plea seeking recall of that split verdict. Further proceedings will determine the course of the challenge to the appointment law.
